Terms & Conditions

Rental Agreement Terms & Conditions 

We are honest with our customers and provide the following information up front prior to your rental, rather than having it appear as a shock later should such an event occur.

Gold Mobility Scooters LLC. rents to the person signing this agreement (further known herein as “Renter”) for a mobility scooter/electric wheelchair/stroller and included accessories (further known herein as “Equipment”) and is subject to all the terms and conditions set forth in this Rental Agreement. The Renter agrees: Equipment is the sole property of Gold Mobility Scooters LLC. and is in good working condition when received. Renter will return the Equipment in the same condition as when received at the end of the rental period for inspection and battery recharge (if necessary), or sooner, upon demand by Gold Mobility Scooters LLC.

Unit Preference & Availability

All scooter rentals are subject to availability. When booking, the choice between a 3-wheel or 4-wheel model is considered a preference only. If a Victory model is booked, the renter will receive a Victory; if a GoGo model is booked, the renter will receive a GoGo. As the 3-wheel and 4-wheel versions of each model serve the same purpose and perform equivalently, Gold Mobility Scooters reserves the right to provide either version without prior notice should the requested option be unavailable.

Personal Property

Gold Mobility Scooters LLC. shall not be liable or responsible for the loss of or damage to any property left, lost, damaged, stolen, stored or transported by Renter, its agents, servants, or employees, or any other person using the Equipment, either before or after the return thereof. Renter assumes all risk of such loss or damage and waives all claims against Gold Mobility Scooters LLC. by reason thereof. Renter agrees to hold Gold Mobility Scooters LLC. harmless from and to defend and indemnify Gold Mobility Scooters LLC. against all claims based upon or arising out of such loss or damage. Renter assumes all risk and liability for any loss, damage or injury, including death, to persons or property of Renter or others arising out of the use of the Equipment.  

Equipment Condition

Renter affirms that Gold Mobility Scooters LLC. provides the Equipment in good operating condition and that the Equipment is clean and free of damage. Renter is responsible for the Equipment and any included accessories and will reimburse Gold Mobility Scooters LLC. for the full cost of replacement upon demand for any damage, loss, theft, or destruction of the Equipment and any included accessories. Renter understands and authorizes that Gold Mobility Scooters LLC. will document any repair or replacement costs of the Equipment and any included accessories.Gold Mobility Scooters LLC. will arrange for the repair or replacement. 

Damages & Payment Obligations

The renter agrees to be financially responsible for any and all damages to the rented equipment that exceed normal wear and tear. Gold Mobility Scooters will issue an invoice for the full cost of such damages, which the renter is obligated to pay in full by the stated due date. If the invoice is not paid, a convenience fee of fifteen dollars ($15.00) per day will accrue until the balance is satisfied. Gold Mobility Scooters also reserves the right to pursue legal action to recover unpaid amounts, including but not limited to attorney’s fees, court costs, and any other expenses incurred in collection.

Delivery Location Requirements

The renter is responsible for providing a valid delivery address at least two (2) days prior to the scheduled delivery date. Failure to provide such information grants Gold Mobility Scooters the right to adjust the delivery date or time at its sole discretion. Renters may choose to collect or return equipment at the Gold Mobility Scooters retail location if preferred; however, no refunds will be issued for missed delivery times or missed rental days resulting from the renter’s failure to provide the required delivery information.

Delivery & Pickup Policy; Convenience Fees

The renter must be present at the agreed delivery location and time. If the renter is absent or late, a convenience fee will apply: thirty-five dollars ($35.00) for Disney property or forty-five dollars ($45.00) for non-Disney locations, for each re-delivery attempt. Re-deliveries will be scheduled at Gold Mobility Scooters’ convenience and subject to availability.

The same policy applies to pickups. If the renter is not present at the agreed pickup time, a convenience fee of thirty-five dollars ($35.00) for Disney property or forty-five dollars ($45.00) for non-Disney locations will be charged. If pickup must be rescheduled to the following day, the renter will also be charged an additional day of rental at the rate of twenty-five dollars ($25.00).

All equipment, including scooters and accessories, must be returned on time. Failure to return equipment when due will result in the same fees stated above. Convenience fees may be waived only if the renter arranges for drop-off or pick-up directly at the Gold Mobility Scooters retail location.

Improper Use & Staff Conduct Policy

Gold Mobility Scooters reserves the right to repossess and terminate the rental agreement immediately if any employee, including delivery personnel, determines that the renter or their party is abusing the equipment, using it improperly, or engaging in behavior deemed hostile, threatening, or abusive toward company staff. This also includes making threats against the company itself, such as stating or implying that a negative review, disparaging remarks, or a chargeback will be made if company policies are not disregarded. In such cases, the contract will be terminated without refund, and the renter remains responsible for all rental fees incurred.

Operation of Equipment

Renter shall require drivers to operate the Equipment with reasonable care and diligence and comply with any polices and ordinances in the locations where it is used along with the terms of this agreement. The following restrictions are cumulative and each shall apply to every use, operation or driving of the Equipment; under no circumstances shall the Equipment be used or operated by any other person under 18 years of age. No 2nd riders of any kind. No phone calls or texting while in operation. Renter shall defend, indemnify and hold harmless Gold Mobility Scooters LLC., all of their agents, officers, servants, and employees from and against any and all losses, liability claims, damages, injuries, demands, actions and causes of action whatsoever, arising out of or related to any loss, damage or injury claimed by persons that may arise from the use, operation or driving of the Equipment, provided that such loss or damage was not caused by the fault or gross negligence and willful misconduct of Gold Mobility Scooters LLC. or its employees. Renter assumes all costs and expenses of every kind and nature, including legal fees and disbursements arising out of and in connection with the use, operation or driving of the Equipment. Gold Mobility Scooters LLC. assumes no liability or responsibility for any acts or omissions of Renter or of Renter’s agents, servants, or employees.

Damage, Loss, Theft and Reporting

Renter shall notify Gold Mobility Scooters LLC. within two hours of any and all accidents and damage resulting from the use, operation or driving of the Equipment. Renter agrees to pay all costs, expenses, and attorneys fees incurred by Gold Mobility Scooters LLC. in collecting sums due or in regaining possession of Equipment or in enforcing or recovering any damage, losses or claims against Renter. The Renter agrees to inform Gold Mobility Scooters LLC.immediately of any defect or malfunction while in use. Once notified, Gold Mobility Scooters LLC. will make every effort to remedy the issue in a timely manner. Renteris responsible for the loss, theft, damage or destruction of the Equipment and agrees to pay the full replacement value for the rental item(s). The Renter also agrees to authorize the replacement cost of the rental item(s) to the Renter’s credit card given at time of rental or delivery. The Renter agrees to return the rental item(s) and all accessories in the same condition as it was delivered, and to report any loss, theft, damage or destruction to the rental item(s) immediately to Gold Mobility Scooters LLC. 

Representation

Renter or driver of the Equipment shall in no event be deemed the agent or employee of Gold Mobility Scooters LLC. in any manner or for any purpose whatsoever. Any individual executing this Agreement as Renter in a representative capacity shall be bound personally, jointly and severally, with such fiduciary, corporation or other entity as to all obligations, expressed or implied, arising hereunder. If any provisions hereof or the application of any provisions to any person or circumstance is held invalid or unenforceable, the remainder hereof and the application of such provision to other persons or circumstances shall remain valid and enforceable.  

Payment Policies

Gold Mobility Scooters LLC. accepts major credit cards (MasterCard, Visa, Discover Card, and American Express) for credit identification and payment at the time of rental. GMS upon delivery may require a Identification like a valid Passport, valid Driver's License or a valid State issued (Non driver’s) Identification Card with picture to verify who we are delivering the item to. Debit Cards can be used only as a form of payment of rental charges. Note: Prepaid Debit/Gift cards are not acceptable methods of credit or identification. Checks/Money Orders are not accepted. 

Cancellation, Early Return & No-Show Policy

Cancellations made two (2) days prior to the scheduled rental will result in a charge equal to one (1) rental day. Cancellations made one (1) day prior to the scheduled rental are non-refundable. Once a scooter has been delivered or is within one (1) day of scheduled delivery, no refunds of any kind will be issued. This includes premium accessories. Early returns, regardless of reason, are non-refundable. Failure to appear for a scheduled rental (“no-show”) will result in no refund being issued.

Rental Extensions and Equipment Return

Equipment and any included accessories are due back at the date/time specified on the rental agreement so the Equipment can be picked up. If you need to extend your rental, you must call prior to expiration date and time to determine if the rental can be extended. Gold Mobility Scooters LLC.may, at its own discretion allow or deny any extension. Gold Mobility Scooters LLC.reserves the right to charge the Renter’s card and Renter agrees to allow the charge of $25 for each additional day or fraction of a day the Equipment is kept by the Renter beyond the prearranged return date and time on the rental contract. A $25 fee will be applied for return trips to pick up rental items if not returned at the agreed upon time as listed in the rental reservation or prior agreed upon written arrangement for return. Renter may request a change of product for reasons of size or transportation issues; the approval of the request is at the sole discretion of Gold Mobility Scooters LLC. and will be based on the availability of equipment and delivery personnel. A $25 fee applies to any exchanges. The Renter is responsible to pay the replacement cost of any lost parts or accessories, whether paid for or provided free of charge. These include but are not limited to: oxygen bottle holders, sunshades, baskets, cane and crutch holders, phone holders, straps, harnesses, stroller consoles, rain covers, coolers, bedding materials, car seat adapters, trays, storage bags and any other accessories provided. These items may be provided for a small fee or free of charge during the rental period but are in no way guaranteed to be available during the rental.  

Dead Battery, Key Loss or Re-Delivery

The Equipment (scooters or electric wheelchairs) are fully charged at time of delivery; Renter is responsible to charge the battery as needed. We recommend keeping the Equipment plugged in overnight whether the power meter shows a discharge or not. The unit is designed to charge automatically, however do not keep the Equipment charger plugged in more than twenty four (24) hours, as damage to the battery can occur. If you forget to charge the battery and become stranded, you may call us and request a delivery of a fully charged battery, at a fee of $50 during business hours if we are able to fit it on our schedule. If Renter loses the key during rental a $10 fee for key replacement fee is charged plus a convience fee of $45 if we need to bring it. 

Printed manual is available upon request at time of rental. It provides safety and operational instructions to safely use / operate the Equipment

Refund Processing Policy

Refund requests may take up to four (4) business days to be processed by Gold Mobility Scooters, excluding weekends, holidays, and any company off days. Once the refund has been processed on our end, the timing for the funds to appear in your account will depend on your financial institution, as all refunds are completed and issued by the bank.
